KCHR: Update on election campaign

 

Dear all,

1) Powers still wanted D.Usenov (MP and the leader of the opposition El
party) to leave the hospital, by the President's Administration instruction
such prominent doctors as academicians Mamakeev, director of the Surgery
Centre and director of the Cardiology Centre Mirrakhimov who investogated
the state of D.Usenov and admitted the illness, but said that no any
surgery needed. Yesterday, head of President's Administration M.Ashirkulov
visited and talked to patient, after that he gave a command to take off the
guards of militiamen since OSCE/ODHIR's visits were expected. After the
medical examination of the above academicians Mirrakhimov and of Mamakeev,
the central entrance of the hospital was strictly closed so that nobody
would hinder to deliver D.Usenov to SIZO No1. ( pre-trial detainment under
the Interior Ministry) as it was originally planned. In addition, the
academicians were forced to give an interview on the State TV channels
(KOORT and KTR). Learning of the OSCE/ODIHR visits the detention of D.Usenov
was postponed, but the trial for January 25, at 10.00 a.m. had been already
known however. On January 24, at 16.00 hours OSCE and NDI representatives
visited D.Usenov, by that time Health Minister ordered to discharge the
patient, otherwise the doctors of the hospital would lose their jobs. Thus,
D.Usenov left the hospital not receiving sufficient medical treatment.
Sanction on arrest of the prosecution General is still in force though the
convoy is revoked. And D.Usenov has to appear at the court which will be
chaired by judge Sutalinova. She, not canceling the sanction, let him home
but ordered to appear at the court on January 25, at 9.45 a.m. which
contradicts the law, it is a great violation - in order to permit
D.Usenov to go home the measure of suppression was to be changed by the
Prosecution-General either by the Judge. But she didn't and let him go home.
Under such an unlawfulness the case of D.Usenov has been lasting for the
last 4 years, whereas Mukaev - plaintiff openly had refused from his
claims and said that he did not have any pretensions. This is a pure
political farce against of opposition.
 
2) Other member of the party El - Tugelby Kazakov is facing difficulties in
getting registration as a candidate to parliament. He was ordered by the
prosecutor of Talas region to provide the proves that he was not sentenced
earlier whereas on the contrary , it is the duty of the prosecutor
himself. But the prosecutor is pressurizing over the electoral commission
not to register T.Kazakov until the latter would provide the official
document on absence of offence. Though the electoral commission said that
the law not requires that, evidently the prosecution office is above the
law.

Today, January 25th is the last day for registration of the candidates to
parliament. And still many of the opposition representatives have not been
registered whereas governmental officials and pro-governmental parties and
blocks obtained a registration with no any problems, and not being bothered
with numerous certificates, notices and incomes proves.

3) Still, does not get registered the Chief Editor of the opposition "Res
Publica" paper - Zamira Sydykova. They do not register her under various
pretexts. Thus, two militiamen (serving as district inspectors) visited
her mother - Klara Kasymbekova to check whether she really lives in that
place as indicated in the documents and the administration of the living
blocks verified how she paid for the utilities. In addition akim (or head
of the administration ) of Leninski district Kakeev B. demanded from war
(meaning the World War II) and labor veterans living in that area to revoke
their nomination of Z.Sydykova threatening to annul all the benefits they
enjoy.

Central Election Commission developed so-called instructions with
reference to the Elections Code, that future candidates are not rightful to
speak in media, and any speeches would be treated as agitation. Thus, all
those who intend to stand for are deprived their rights of freedom of
expression . The journalists are forbidden to cover of them.
