Subject: Pre-elections

Dear all,

1)President's Administration is taking a revenge for criticizing the cause
of the current pre-elections, including the rejection of democratic
elections and violations of human rights.

In view of the numerous complaints on blatant violations of voters'
rights in pre-election campaigns from the side of authorities towards
political opposition parties and their leaders, on unlawful trials and
judicial harassment by intelligence forces, governors and heads of local
administrations, statements made by NGOS, human rights activists and OSCE
and NDI , representatives of the West , the President A.Akaev held a
meeting (Feb.08,2000) with the communities, mass media, governors, and heads
of law-enforcement bodies. Regrettably, those who had actually addressed
the President and other public officials drawing attention to the
violations of human rights, of electorates and of the candidates as well as
of non-observance of OSCE requirements , were not allowed to this meeting,
i.e. the leaders of the Kyrgyz Committee for Human Rights (R.Dyryldaev),
Coalition of NGOs for Democracy and civil society (T.Ismailova), "Centre
"Interbilim" (A.Sasykbaeva), officers of the USA Embassy (T.Burkovskaya,
Kirk Slate), the OSCE officer for political issues Mikhail Miladze . Though
Akaev at the meeting raised the prompt issues like violation of the Kyrgyz
Constitution, Elections Code , requirements of OSCE on human dimensions,
he did not say a ward on facts of persecution of opposition and
independent candidates. However, Akaev admitted that the community is
concerned of the cause of elections. He also slightly mentioned that the
USA vice-president Al Gore sent a letter with expression of his concern of
the pre-election developments in our country.

The officers of the USA Embassy and OSCE office were included into the list
of those to be invited . But when they came , they found out that their
names were crossed out from that list. and the human rights defenders were
not included at all. Akaev demanded from the Prosecution General to
observe the laws.

We believe that this meeting was organized to deceive the community,
including the international one, again.

 
2) Psychological torturing or harassment of Daniyar Usenov.
 
The same day (or Feb.08, 2000) in violation of a judicial practice a trial
over Daniyar Usenov was resumed. In the morning, a judge G.Sutalinova
assigned for this trial before was replaced by Jakupov who not
investigating the case started to proceed the trial. The trial continued
in absence of one of the defenders of D.Usenov who was sick, and in
accordance with the Criminal Procedural Code of Kyrgyz Republic the trial
can not be proceeded in absence of one of the sides. The judge was rude and
it was evident that he had been ordered to get the trial finished at any
rate. Because of continued arbitrariness, health condition of D.Usenov
worsened and he had again to apply to the doctors who confirmed of his
poor state and impossibility to go on the hearings and demanded to
postpone the trial. Only after that the trial was postponed.
 
3) Akaev had no soon held a meeting than complaints on violations of
authorities were reported again. Thus, heads of local administrations
force all businessmen to gather money for the use of pre-election
campaign of the pro-governmental party "Adilet", block of SPS (or Union
of Patriotic Forces) . Powers put tolls all businesses irrespective of
their views. For instance, manager of "Yrakat" cafe M.Baizaliev is being
forced to pay. He says that all the others are in a similar situation
otherwise they would fell under continued disturbances of authorities, i.e.
they have to pay 1000 soms to the political pro-governmental party "Adilet"
and above block of Union of Patriotic Forces headed by ex- vice premier
B.Silaev. The overall situation is analogous.

Businessmen of Kyrgyzstan are literally crying because they suffer from
repeated benevolence gathered under pretence of holding different marathons
and bribes they have to pay fiscal and prosecution bodies and other
authorities. Most of them closed or intend to close their businesses
because of arbitrariness and having a business in Kyrgyzstan is not
becoming attractive and bringing profits.
