Web usage agreement between OSI and the user
Visits to and use of the www.EurasiaNet.org web site (the "Site") constitute acknowledgment of and agreement with the following terms and conditions (hereinafter, "Agreement"):
The Open Society Institute ("OSI") maintains and administers the Site as a courtesy to those who may choose to access the Site ("Users"). The information presented herein is for information purposes only. OSI is pleased to allow Users to visit the Site and download and copy the information, documents and materials (collectively, "Materials") from the Site for Users' personal, non-commercial use, with no right to resell, redistribute, or create derivative works therefrom, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to discrete material within the Site.
Unless expressly stated otherwise, the findings, interpretations, and conclusions expressed in the Materials are those of the various authors of the Materials and are not necessarily those of OSI.
MATERIALS PROVIDED ON THE SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
OSI specifically disclaims any and all warranties or representations as to the provenance, accuracy, ownership, control, or completeness of the Materials. OSI may add, change, improve, or update the Materials in its sole, exclusive, and confidential discretion and without notice of any kind whatsoever. Under no circumstances shall OSI be liable for any loss, damage, liability, or expense incurred or suffered that is claimed to result or arise from visits to or use of the Site, including, without limitation, any fault, error, omission, interruption, or delay with respect thereto. Visits to or use of the Site is at User's sole risk. Anything to the contrary notwithstanding, under no circumstances whatsoever, including, without limitation, negligence, shall OSI or its trustees, officers, employees, agents, affiliates, information providers, content providers, predecessors, or successors be liable to any extent whatsoever for any direct, indirect, incidental, special, or consequential damages that arise or may arise from visits to or use of the Site, even if OSI has been specifically advised of the possibility of such damages. User specifically acknowledges and agrees that OSI is not liable for any conduct of any User. The Site may contain advice, opinions, and statements of various information providers and content providers. OSI neither represents nor endorses the accuracy or reliability of any advice, opinion, statement, or other information provided by any information provider or content provider, or by any user of the Site, or by any other person or entity. Reliance upon any such opinion, advice, statement, or other information shall be at Users' own risk. Neither OSI nor its trustees, officers, employees, agents, affiliates, information providers, content providers, predecessors, or successors, nor any of their employees, information providers, or content providers shall be liable to any User or to any other person or entity for any inaccuracy, error, omission, interruption, timeliness, untimeliness, completeness, deletion, defect, failure of performance, computer virus, communication line failure, alteration of, or use of any content herein, regardless of cause, for any damages which result or may result therefrom.
As a condition of use of the Site, User agrees to indemnify and hold harmless OSI and its trustees, officers, employees, agents, and affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including attorneys' fees) arising out of User's use of the Site, including, without limitation, any claims alleging facts that, if true, would constitute a breach by User of the terms and conditions hereof. If User is dissatisfied with any material on the Site or with any of terms and conditions of use of the Site, User's sole and exclusive remedy is and shall be to discontinue using the Site.
Disputes concerning the terms and conditions of this Agreement shall be resolved by binding arbitration to be held at the New York, New York offices of the American Arbitration Association. The laws of the State of New York shall govern said arbitration proceeding, without reference to that state's choice-of-law rules. Each party to said arbitration proceeding shall be solely and exclusively responsible for the payment of its own attorneys' fees.
Publicly available materials, links to third-party web sites.
Certain materials appearing on the Site reproduce original content publicly available on other web sites at the time of said materials' first appearance on the Site. OSI and EurasiaNet.org hereby disclaim ownership of said materials, publicly available on the World Wide Web of the Internet at the time said materials first appear on the Site. The right, title, and interest, including, without limitation, that of copyright, in and to said materials rests solely and exclusively with said materials' owners or controllers.
The Site contains links to third-party web sites. Said third-party web sites are not under the control of OSI or EurasiaNet.org, and OSI hereby disclaims responsibility for the content of any linked site or any link contained in a linked site. OSI provides these links only as a convenience, and the inclusion of a link does not imply endorsement of the linked site by OSI.
If the Site contains bulletin boards, chat rooms, access to mailing lists or other message or communication facilities (collectively, "Forums"), User agrees to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, User agrees that when using a Forum, User shall not do any of the following:
- - Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
- - Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information.
- - Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless the User owns or controls the rights thereto or has received all necessary consents.
- - Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
- - Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
- - Falsify the origin or source of software or other material contained in a file that is uploaded.
- Advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters.
- - Download any file posted by another user of a Forum that you know, or reasonably should know, cannot be legally distributed in such manner.
User acknowledges and agrees that all Forums or Discussion Groups are public and not private communications. Further, User acknowledges and agrees that chats, postings, conferences, e-mails and other communications by other users are not endorsed by OSI, and such communications shall not be considered reviewed, screened, or approved by OSI. OSI reserves the right for any reason to remove, without notice, any contents of the Forums received from Users, including, without limitation, e-mail and bulletin board postings.
Use of Content from the EurasiaNet Website
The contents of the EurasiaNet Website are the sole and exclusive property of the Open Society Institute. All rights, including, without limitation, those of copyright, in and to said contents are reserved by the Open Society Institute. By entering this website, you acknowledge and agree to the foregoing.
